the unit is a brick kiln fall under orange category the unit has obtained the last CTO vide no -HSPCB/Consent/ : 2821016PALCTOA2506655 Dated:22/01/2016 valid upto 31/041/2017 now unit ha applied for renewal of the consent on 19/04/2017/ after verification of the application form the following deficiencies were found :- 1. not submitted the copy of valid licence from DFSC. 2,. not submitted the copy of valid licence from mining deptt. 3. not submitted the land details where the unit exists whether less then or more then 1 Acrs .4 . not submitted the proper under taking regarding the use of fly ash 5 not submitted the compliance of the conditions of the previous consent pls issue the SCN for refusal to the unit.

The Point wise reply is given as below: 1. We have submitted the copy of valid licence from DFSC. 2. We have applied for licence from mining deptt but the same was not issued till date as and when the mining license will received, the same will be deposited in your office. 3. We have submitted the copy of DFSC license and the land details is mentioned in its letter. 4. We have submitted the undertaking regarding the use of fly ash 5 not submitted the compliance of the conditions of the previous consent. You are requested to grant the consent for the period 01-04-2017 to 31-03-2019 please.

the unit has submitted the reply but the following observations are still pending 1. not submitted the copy licence from mining deptt or any proof of apply in the concerned deptt . 2. Not submitted the compliance of direction regarding the change of technology into High Draught induced ZIG-ZAG Technology 3.not submitted the compliances of last consent i.e 1) The unit will submit the analysis reports of air emission/noise/ monitoring report, from all sources as applicable, within 03 months from the date of issue of renewal of CTO. 2) The unit will obtain the silence from DTP and will submit the same in hard copy in the office with in 02 months pls reissue the SCN to the unit.

The Point wise reply is given as below: 1. Mining license application submitted in mining department but not issue till date as and when issued the same will be submitted. 2. Present APCM will be converted to ZIG-ZAG Technology before the next session. 3. The monitoring has already been submitted. 4. Our bhatta does not falls under the control area of Town & Country Planning Dept. You are requested to grant the consent to operate for the period 2017-19 please.

The copy of monitoring certificate of stack emission. 5 The unit has also submitted that the above said brick kiln is out of control area of DTP department. 6. We have submitted the copy of monitoring certificate. 7. The unit has submitted the undertaking regarding not to excavate brick earth more than 1.5mt from the adjoining ground level, to use fly ash, not to use illegal fuel and regarding compliance of the outcome of decision in Civil Appeal No. 6373/2015 titled as Haryana Brick Kiln Owners Association V/S Union of India & Ors in hon'ble Supreme Court. In view of above, this case may be decided at RO level and CTO under Air Act may be granted to the unit for 02 year for the period 19-04-2017 to 31-03-2018 with general conditions of the Board. 1. Unit will not excavate brick earth/ordinary clay more than a depth of 1.5 meter from adjoining ground level as per notification of department of mines, Haryana dt. 23-01-2013 (2) Unit will not use any illegal/ unauthorized fuel (3) Subject to the outcome of the decision of Hon'ble Supreme Court in Civil appeal no. 6373/2015 in the matter of Haryana Pardesh Brick Kiln Owner Association V/s Union of India & Ors. (4) The unit will abide to Moef notification regarding fly ash notification to use fly ash as per directions of Hon’ble Supreme Court/Punjab & Haryana High Court. 5. Unit will submit performance security within 15 days. 6. Unit will submit the compliance report regarding the converting of present technology into zig-zag technology before before 30-09-2017 otherwise the CTO granted to the unit may be treated revoked automatically.
