The said unit is a mining project. The unit has obtained the CTE. Now unit has applied for 1st consent to operate. As per the latest inspection policy para no. 4.2.1 which read as "Ist Consent to Operate. No separate trial consent will be granted. Ist consent to operate will include trial consent. Inspection of the industry will be carried out by the authorized officer/ officers of the Board before commissioning of the production in the unit and before giving the Ist CTO, after approval from the Competent Authority to check the status regarding installation of pollution control measures/ devices undertaken at the time of obtaining the CTE as well as their structure adequacy before deciding the cases of Ist CTO. After grant of the Ist CTO the inspection of the unit will be carried out by the authorized officer within a period of 3 months of grant of Ist CTO for collection of samples of effluent/ air emissions/ noise in case sampling is required. In case the analysis report of samples of Air/ effluent/ noise so collected are found complying the standards prescribed under EP Rules, 1986,the Ist CTO so granted will remain valid for the period of CTO for which it has been granted based upon the category of the unit or as was demanded by the unit but in case of failure of sample the Ist CTO so granted will be revoked/cancelled after following the due procedure". --This unit has obtained the CTE previously and now as per the policy of the board sample is must for granting the regular consent to the unit, ......In view of above, it is therefore requested that the permission may be granted to this office to conduct the inspection and collection of sample from the unit, please.

The said proposed project is a mining project as sand mining for site area 25.56 Ha Mandoli Ghaggar East block/ YNR B 4 for a period of 07 years having capacity of 11,91,000 TPA in distt Yamuna Nagar. The CTO fees of amounting to Rs 425000/- vide DD No 060254 Dated 13.04.2017 & ( 300000 DD NO.060238, 200000 VIDE DD NO.060239 DATED 06.04.2017) . The unit has submitted NOC from District Town Planner, Ymn vide letter no E-198 Dated 06.02.2017 and NOC from District Forest Officer, Ymn vide Letter No 228 dated 25.04.2016. The unit has also obtained the Letter of Intent (LOI) from Director General, Mines & Geology Department, Haryana vide Memo No DMG/HY/Cont/M.G. Block/ YNR B 4/2015/3918 dated 19.06.2015. The annual license fees of the project is 04,20,50,000/-.The unit has submitted the Environment Clearance from SEIAA, Pkl vide Letter No SEIAA/HR/2016/985 dated 21.12.2016. The unit has also submitted the necessary documents as per check list of CTEIn view of above, it is recommended that consent to operate may be granted to the unit for the year 09.04.2017 to 30.09.2018 with the usual terms & condition of the Board and other specific condition of the Board. 1. That the unit will submit the analysis report from the Board lab within one month from the date of issue of first consent to operate. 2. That the unit will run and maintain the APCM & green belt. 3. The point wise compliance of the observation raised by the head office is as under :- 1. The OA NO 184/2013, 176/2016 & 272/2016 titled GURPREET SING BAGGA vs MoEF & CC is still pending in the honble NGT and further direction has been received in said OA.2 The hazardous waste rules is not applicable on the unit as their is no generation of waste oil and other hazardous waste.In view of the above it is again recommended that consent to operate may be granted to the unit for the year 01.04.2017 to 30.09.2019 with the usual terms & condition of the Board and other specific condition of the Board:- 1. That the unit will submit the analysis report from the Board lab within one month from the date of issue of first consent to operate. 2. That the unit will run and maintain the APCM & green belt. 3. That the unit will apply for renewal of consent to operate before 90 days from the expiry of this CTO. 4. That unit will abide with all the condition mentioned in the Environmental clearance obtained from SEIAA, Panchkula vide letter No SEIAA/HR/2016/989 dated 21.12.2016 and submit compliance report. 5. After grant of the Ist CTO the inspection of the unit will be carried out by the authorized officer within a period of 3 months of grant of Ist CTO for collection of samples of effluent/ air emissions/ noise in case sampling is required. In case the analysis report of samples of Air/ effluent/ noise so collected are found complying the standards prescribed under EP Rules, 1986, then Ist CTO so granted will remain valid for the period of CTO for which it has been granted based upon the category of the unit or as was demanded by the unit but in case of failure of sample the Ist CTO so granted will be revoked/cancelled after following the due procedure. 6. That the unit will comply the Order of NGT, New Delhi vide Dated 01.06.2016 & 06.06.2016 in the case of the OA NO 184/2013, 176/2016 & 272/2016 in the case of GURPREET SINGH BAGGA vs MoEF & CC and subjected to final outcome/decision of the case. 7. That the unit will abide by the directions of CPCB/HSPCB/any other competent authority time to time. 8. That the unit will abide the directions/ orders of Hon"ble Supreme court /High Court/NGT/any other court. 9. The Proponent will abide by the recommendations of the HIGH POWER COMMITTEE CONSTITUTED by the Hon`ble NGT in the OA NO 184 OF 2013 in the case of GURPREET SINGH BAGGA vs MoEF & CC and subjected to final outcome/decision of the case.
