Sub:- Show Cause notice for refusal of consent to operate under Section 25/26 of Water Act, 1974, Section 21/22 of Air Act, 1981 and Authorisation under Hazardous & other wastes (Management and Transboundary Movement) Rules, 2016. Ref:- Vide your office letter no. O18SONCTOA/W/HWMSCN3960501 dated 18.02.2018 Point wise replay are as under:- 1. The DD of CTO fee with noise monitoring fee of Gen. Set is enclosed herewith. Water sample fee has already been deposit online to HSPCB on dated 06.03.2018. The performance security is not applicable for Govt. University/ Institutions. 2. The copy of undertaking of authorized signatory of BPSMV is enclosed herewith. 3. The waste oil agreement has been signed by the BPSMV & the same has been sent to M/s Divya Petro Products, Sonipat for signature which will be submitted shortly. 4. The detail of DG Set is enclosed herewith. 5. The certified copy of CA certificate is enclosed herewith. 6. The STP is working smoothly & the photograph is enclosed herewith. 7. The copy of feasibility report with design calculation etc. is enclosed herewith.

HO LEVEL CASE....The said unit is a govt. university and covered under Red category of the unit (Sr no.-74) as per latest notification. The CTE of the unit was refused vide online application no. 3750573 dt. 16.02.2017 and SCN for the prosecution was issued to the university. Now university has applied for the CTO after decided of CTE and submitted Rs. 25000/- as CTO fees for the five years @5000 per year. As per HO office order no HSPCB/EE/261/2548 dt 23.11.2017 fees should be charged from the university being Govt. Institute for Rs 5000/- per year ,Moreover HSPCB has granted CTO to the similar case of DCRUST Murthal ,Sonipat with the CTO fees of Rs. 5000/- annually . The university is not having any trade effluent and provided 3.0 MLD capacity FAB Technology STP for the treatment of Domestic effluent and as per latest Analysis report from Haryana Test House , Panipat (HR.) as approved by the board vide no. 180306027 dt. 12.03.2018 All the parameters are within prescribed limits. University is no having any air emissions except D.G set. University has provided Acoustic enclosure and proper stack height on the D.G sets and University has submitted latest noise testing report vide no 180306029,30,31,32,33,34,35,36,37,38,39,40,41,42,43,44,45,46,47,48 dt. 12.03.2018 for DG set (25,62.5,82.5,100,125,160,320,600 KVA)Total=20 no DG set which is within limits prescribed. University has submitted all the documents as per check list. .In view of the above, if approved CTO under Water act , Air act for the period 09.03.2017 to 30.09.2021 may be granted to the unit as per policy of the board with the conditions that :1.University will handover waste oil of D.G set only to the Authorized recycler. 2. University will run STP regularly and maintained log books properly. 3. University shall keep all the parameters within the prescribed limits and shall comply with all the Norms and Rules as prescribed in the Act 4.University will provide inter locking arrangement of DG set with STP and shall have separate D.G. set to ensure regular and effective running of pollution control devices. 5. University will not discharge any untreated effluent inside and outside its premises. 6. University will comply with all the provisions of Hazardous Waste Rules, if applicable.7. That the CTO/ Authorization so granted shall become invalid in case of violation of any of the above / any law of the land.

As proposed by FO, case is fit for grant of CTO under Water act , Air act for the period 09.03.2017 to 30.09.2021 may be granted to the unit as per policy of the board with the conditions that :1.University will handover waste oil of D.G set only to the Authorized recycler. 2. University will run STP regularly and maintained log books properly. 3. HO LEVEL CASE......It is submitted that As per HO order vide no-HSPCB/EE/3271 dt 16.02.2018 and decided in the minutes of TAC meeting held on 10.08.2017,09.10.2017 and 16.11.2017 (Copy enclosed) No ex-post facto CTE will be given in such cases of past violation as no such provisions is available in Water Act, 1974 and/or Air Act, 1981.Further prosecution action shall be initiated against the University and SCN for the prosecution has already been issued to the university .So, CTO case may be granted as above ,submitted please.

Firstly Recommend sanction for prosecution to HO

In this connection it is submitted that recommendation for sanction of prosecution has been send to HO vide no HSPCB/SR/2018/703 dt 19.04.2018 , if approved CTO under Water act and Air act may be grant as above ,submitted please.

In this case CTO can only be granted to the unit after filing the prosecution as per policy of the board .Process the case as per policy of the board .

HO level case.....As discussed with your good self and as per the policy order dt. 26.02.2018 the CTO can only be granted to the unit after filing of prosecution in the special environment court , therefore as per policy order dt. 23.02.2018 CTO cannot be granted to the unit till the filling of prosecution and the same is in process , therefore CTO may be refused in lieu of policy of the Board.
