The said unit is a Ready Mix Concrete Plant. The said RMC plant is dedicated only for Group Housing Project at village-Naurangpur, Sector -79, Gurugram & it was closed by Board being non applicant under Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981. It was closed by sealing the plant & machinery on 13-04-2017 in compliance of head office letter No. HSPCB/2017/3566-68 dated 10-03-2017 & the compliance of closure order sent to Head Office vide this office letter no. 360 dated 13-04-2017. Unit applied for CTO online alongwith CTO fees. The unit submitted copy of Environment Clearance, copy of CTE & license of DTCP, Gurgaon. The said Readymix concrete plant has submitted their justification in this office regarding their establishment. As per the unit’s letter, the EC for the said project was granted on 12-12-2013 and the CTE was granted to the unit from the Board on 03-02-2014, but due to some unavoidable circumstance, the construction of the unit was started later. The unit has submitted the receiving of half yearly compliance reports of EC conditions in this office stating that their construction was not started till 28-12-2015, which shows that their operation of RMC plant was not started till 28-12-2015. The said unit is having Capital investment of Rs. 30 Lakhs and as per Head Office order no. HSPCB/2014/1804-22 dated 11-06-2014, the unit was exempted from getting CTE/CTO from the Board. The said unit has been now covered in Green category at Sr. No. 37 as per Head Office order No. HSPCB/PLG-135/2016/546-572 dated 14-07-2016 and order No. HSPCB/PLG-171/2017/4081-4106 dated 19-05-2017 (which is defined as Sr. No. 22 as RMC plant are covered under consent management irrespective of investment cost). As per the justification submitted by the unit , the unit has been established after 28-12-2015 and need not to obtain CTE/CTO from the Board till 19-05-2017. The unit has already applied for CTO online on OCMMS. Keeping in view of above facts, it is submitted that the closure order against the said Readymix Concrete Plant may be suspended as already proposed vide this office letter No. HSPCB/GRS/2017/373-74 dated 17-04-2017 so that the CTO case could be decided within time as per policy of the Board. The case is also sent to Head Office in Hard Copy (Copy of reply against Head Office letter No. HSPCB/Sc-C/2017/1331 dated 12-07-2017 is Attached)

The unit had submitted request for suspension of closure orders and recommendation for the same has already been sent to Head Office in hard copy also. The CTO case is pending for a long time period before the Board as the request of the unit in this regard is not decided yet. So the case may be sent to competent authority and may be requested to advice whether the online CTO case should be refused or may be kept on hold till the decision of suspension of closure orders.

The unit was closed by the Board and in compliance of the closure orders, the unit had applied for CTO online and also submitted request for suspension of closure orders. The recommendation for the same has already been sent to Head Office in hard copy also. The CTO case is pending for a long time before the Board as the request of the unit in this regard is not decided yet. As the HEPC is monitoring and regulating the days for deciding any application but this application could not be decided till the decision of suspension of closure orders comes from competent authority. The case will be decided as and when the decision received in this regard. So the case may be sent to nodal officer of HEPC and may be requested to freeze the application until the decision on suspension of closure orders comes from competent authority.

In view of the facts mentioned by the field officer the case is forwarded to nodal officer of HEPC and it is requested to freeze the application until the decision on suspension of closure orders received from competent authority to avoid unnecessary pendency on the part of board.

The said unit is a Ready Mix Concrete Plant and falls under green category. Earlier vide Board order No-HSPCB/2014/1804-22 dated 11-06-2014, RMC plants having investment cost less than 1 crore were exempted from consent management and in the new notification dt 14-07-2016 and further clarification dated 19.05.2017, RMC plants are now covered under green category of units. The above said RMC plant is dedicated only for Group Housing Project at village-Naurangpur, Sector -79, Gurugram & it was closed by the Board due to non applicant vide Board order No. HSPCB/2017/3566-68 dated 10-03-2017 and after applying CTO alongwith required documents and required consent fees, the case of suspension of closure orders was sent to the Head Office through Hard copy vide this office letter No. HSPCB/GRS/2017/373-74 dated 17-04-2017 and same is pending in Head Office due to policy decision to be decided by TAC. Now as per the discussions with Dr. S.K.Rohilla, Scientist C, HQ, HSPCB, TAC has given its opinion that in these type of cases, closure orders can be suspended without initiating prosecution action against these units. In view of above it is again recommended that closure orders issued by the Board may be suspended with the following conditions : 1. The unit will submit A/R of Effluent/Air emissions/Noise, as applicable within 20 days from the date of issue of suspension of closure orders. It is also requested that the application may also be defreezed so that CTO application could be decided.

Put up case after discussion with Sc B in context to the case submitted in hard copy for suspension of closure orders.

As per the discussions held with Dr. S.K Rohilla, Sc-C telephonically on 17-02-2018, the closure orders of RMCs has been suspended and the CTO may be granted to the units. So in view of this the approval for de-freezing may be got accorded from the Competent Authority and application may be defreezed in OCMMS.

The unit will run and maintain its APCM regularly and properly & will keep all the parameters within limit. 3. The unit will comply with provision of all applicable Acts/Rules/Direction of the Board.4. Unit will get prior permission from the board before installing any polluting process in the unit. 5. The unit will comly the conditions of suspension of closure orders, whenever orders will be issued. 6. The unit will install and operate the pollution control measures as per the guidelines of RMCs dt 24.12.13 and comply with the directions issued time to time for the RMCs.
