In this connection it is submitted that unit has already granted CTO upto 31.3.2017. SCN was issued to the unit on 16.2.2017 to submit any proof for deposit of CTO fees under Air Act and Water Act as per prescribed schedule, Fresh analysis reports of effluent and air emissions from all Sources as applicable, not submitted the renewal of CTO application in prescribed Performa , copy of agreement made with approved facility and latest manifest for disposal of hazardous waste, Annual report under HWM Rules nor Environment statement, Not Clarified the CTO case belongs to expansion project or it is a renewal case, Not clarified as submitted Total investment cost of the project 26.0 Cr. in the CA certificate and 1629.0 Lakhs in the on line application, Annual return under the Provision of Batteries (Management and Handling) Rules, Not filled up relevant information in the application form. REPLY TO THE SHOW CAUSE NOTICE HAS BEEN UPDATED IN ONLINE APPLICATION ON 31.03.2017 COPY OF THE REPLY LETTER HAS BEEN ANNEXED HEREWITH FOR YOUR REFERENCE.

Unit has submitted reply after submission of recommendation. Re-examine the case in the light of reply submitted by the unit and resubmit with fresh recommendation accordingly.

In this connection it is submitted that unit has applied CTO under Water Act/ Air Act/ H &OW(M&TM) Rules and deposited CTO fee as per schedule. CTO case was recommended for refusal on 19.3.2017 as unit had failed to submit the reply of SCN issued on 16.2.2017.Now, unit has submitted analysis report under Air Act, Monitoring report under Noise Level Rules, renewal CTO application in prescribed Performa, copy of agreement made with approved facility for disposal of hazardous waste, Annual report under HWM Rules, Environment statement and submitted that CTO case belongs for renewal. Further unit submitted that they are engaged in the mfg. of battery parts only by way Plastic granules. Unit is neither generating trade effluent nor any air emission during the process. Unit is complying under Water Act/Air Act/HWM, Rules. Keeping in view of above, it is recommended that Consent to Operate under Water Act,1974 & Air Act, Authorization under HWM, Rules 1981 for the year 01.04.2017 to 31.03.2020 may be granted to the unit with general & specific conditions of the Board.Copy of agreement made with approved facility for disposal of hazardous waste, Annual report under HWM Rules, Environment statement is enclosed herewith and renewal CTO form & A/R submitted in Document detail of the application form.

As per observation, unit has already submitted/ made agreement with approved facility having copy along with other relevant documents may be see in the Note History dated 28.4.2017. Observations still not addressed as agreement with authorized Facility for disposal of ETP Sludge not declared? and whether used oil recycler is authorized?

Unit is not generating any kind of effluent during the process except waste oil for which unit has submitted agreement with authorized facility. Unit is complying under Water Act/Air Act/HWM, Rules. Keeping in view of above, it is recommended that Consent to Operate under Water Act,1974 & Air Act, Authorization under HWM, Rules 1981 for the year 01.04.2017 to 31.03.2020 may be granted to the unit with general & specific conditions of the Board.Copy of agreement made with approved facility for disposal of hazardous waste, Annual report under HWM Rules, Environment statement may be see in the note History dated 28.4.2017 and renewal CTO form & A/R submitted in Document detail of the application form.

As recommended by AEE,Consent to Operate under Water Act,1974 & Air Act,1981 Authorization under HWM, Rules 2016for the year 01.04.2017 to 31.03.2020 may be granted to the unit with general & specific conditions of the Board.

As recommended by RO, may if approved, grant the consent to operate under Water Act, Air Act and authorization under HWM Rules for the period 01.04.2017 to 31.03.2020 with usual terms and conditions specified by the board and recommended by RO with following additional conditions: 1.Unit will not discharge any trade effluent inside or outside their premises. 2. The unit will not use any source of air emissions except DG sets.. 3.The unit will maintain acoustic enclosures/chamber and proper stack height prescribed by the Board on their DG Sets to meet the prescribed standards under EPA rules, 1986 . 4. The unit will submit the Environment Statement by 30th September every year in case of L&M scale units. 5.Unit will apply for renewal of consent/ Authorisation at least 90 days before expiry date of the consent. 6. The unit will submit the Annual Report under HWM Rules by 30th June every year. 7.Unit will not generate and discharge any kind of Hazardous waste except used oil from DG Sets and same will be sold only to authorized recyclers of the same for recycling.

Recommended for grant of consent to operate the unit for the period from 01.04.2017 to 31.03.2020 under the provisions of Air and Water Acts and authorization under HWM Rules with the conditions applicable, as proposed.
