Unit may be asked whether CTO applied for expansion or for renewal so that CTO case may be decided accordingly as per Policy of the Board as unit have obtained CTE for Expansion recently

Dear Sir, Please find attached reply of Clarification raised our application for CTO for expansion.

In this connection it is intimated that unit has granted Consent to Establish for expansion through OCMMS vide No. HSPCB/Consent/ : 320221416REWCTE3251359 Dated:07/11/2016.Now unit has applied first time after expansion and CTO case is pending on OCMMS as inspection of the industry will be carried out to check the status regarding installation of pollution control measures/devices as per scheme submitted by the unit at the time of obtaining the CTE for expansion as per policy order dated 24.02.2016. Therefore, Permission from Competent Authority may be sought to inspect the unit.

Please grant permission for inspection as unit has applied first time after expansion and CTO case is pending on OCMMS as inspection of the industry will be carried out to check the status regarding installation of pollution control measures/devices as per scheme submitted by the unit at the time of obtaining the CTE for expansion as per policy order dated 24.02.2016.

Permission for inspection of the unit may be granted to RO/ FO for processing the consent case as requested by RO in view of inspection policy of the Board and RO will submit the comprehensive inspection report on prescribed proforma and report on compliance Status regarding installation of all the required pollution control measures proposed by unit at the time of obtaining CTE and Comments on their structural adequacy alongwith report on Compliance of conditions of CTE .

Permission granted for inspection and collection of samples, as proposed

SCN may be issued for following shortcomings:- 1) Whereas you have not submitted CTO fee under Water Act/ Air Act as per schedule 2) Copy of agreement made with approved facility under HWM, Rules - Not submitted 3) Applied the period of Consent to Operate as per Policy of the Board. 4) Not furnished following relevant information in the column of application form;- a) Not Submitted the detail-If the location satisfy the requirements under relevant Central/State Government notifications on ecologically fragile area etc., b) Fuel consumption and detail of stack i.e Gas quantity Nm^3/hr: , Gas Temperature 'C: , Exit velocity of Tones/sec- not submitted 5) Whereas you have neither submitted Water sampling testing fee for effluent sample nor Noise Monitoring testing fee for DG set as per schedule .

In this connection it is submitted that unit has already granted CTO upto 31.3.2017.Unit has obtained CTE for expansion vide No. HSPCB/Consent/ : 320221416REWCTE3251359 Dated:07/11/2016 through OCMMS and applied fresh CTO after expansion.SCN was issued to the unit on 15.3.2017 to submit CTO fee under Water Act/ Air Act as per schedule, Copy of agreement made with approved facility under HWM, Applied the period of Consent to Operate as per Policy of the Board, Not furnished following relevant information in the column of application form;- a) Not Submitted the detail-If the location satisfy the requirements under relevant Central/State Government notifications on ecologically fragile area etc., b) Fuel consumption and in the column detail of stack - Gas quantity Nm^3/hr: , Gas Temperature 'C: , Exit velocity of Tones/sec- not submitted. Unit has not submitted the reply of SCN issued till date. Keeping in view of it is recommended that CTO under the Provision of Water Act/Air Act/ Authorization under HWM, Rules may be refused as unit has failed to submit following compliance:- 1) Unit has neither replied nor complied the observation of SCN issued on 15.3.2017 2) Not deposit CTO fee under Water Act/ Air Act as per schedule as unit has applied for the period 10.1.2017 to 31.3.2018 (for 2 years) 3) Copy of agreement made with approved facility under HWM- Not submitted 4) Not furnished following relevant information in the column of application form;- a) Not Submitted the detail-If the location satisfy the requirements under relevant Central/State Government notifications on ecologically fragile area etc., b) Fuel consumption and in detail of stack i.e Gas quantity Nm^3/hr: , Gas Temperature 'C: , Exit velocity of Tones/sec- not submitted

As proposed by AEE, it is recommended that CTO under the Provision of Water Act/Air Act/ Authorization under HWM, Rules may be refused as unit has failed to submit following compliance:- 1) Unit has neither replied nor complied the observation of SCN issued on 15.3.2017 2) Not deposit CTO fee under Water Act/ Air Act as per schedule as unit has applied for the period 10.1.2017 to 31.3.2018 (for 2 years) 3) Copy of agreement made with approved facility under HWM- Not submitted 4) Not furnished following relevant information in the column of application form;- a) Not Submitted the detail-If the location satisfy the requirements under relevant Central/State Government notifications on ecologically fragile area etc., b) Fuel consumption and in detail of stack i.e Gas quantity Nm^3/hr: , Gas Temperature 'C: , Exit velocity of Tones/sec- not submitted

As proposed by AEE, it is recommended that CTO under the provision of Water Act/ Air Act/ Authorization under HWM, Rules may be granted ( 1.4.2017 to 31.3.2018) to the unit ( orange Category)with usual terms & Condition as per Policy of the Board and with the specific condition that unit will submit A/R under Water /Air Act( from all source of air emission)/Monitoring report under Noise Level rules within three months.

It has not been not reported if the unit has applied for existing plant or for expansion project or for both. In case it has been applied only for expansion project then report regarding compliance of CTE conditions and installation of all pollution control measures proposed at the time of obtaining CTE is required. In case of renewal case, policy for the same should be adhered while recommending the case.

In reference to observation from HO it is submitted that unit has applied for expansion. Unit has installed of all pollution control measures proposed at the time of obtaining CTE. Keeping in view of above it is recommended that CTO under the provision of Water Act/ Air Act/ Authorization under Hazardous and other Waste ( M& TM)WM, Rules 2016 may be granted ( 1.4.2017 to 31.3.2018) to the unit ( orange Category)with usual terms & Condition as per Policy of the Board and with the specific condition that unit will submit A/R under Water /Air Act( from all source of air emission)/Monitoring report under Noise Level rules within three months.

1. Describe installation of Pollution Control Measures for proposed expansion alongwith quantum of pollution generated and certify that the same are structurally adequate 2. Whether unit is complying all applicable environmental laws, if yes, details of applicable laws and compliance thereof at present stage so as to ascertain consent for expansion

In this connection, it is submitted that unit has installed Pollution Control Measures i.e ETP for proposed expansion as per scheme submitted at the time of obtaining CTE having generation effluent quantity from process is very low i.e .6 KLD. Unit has already installed adequate STP and latest A/R submitted for recognized Laboratory of the Board found within prescribed limit.Further, no air emission will be generate during the process. 2) Unit is complying all applicable environmental laws and submitted necessary documents for expansion as per policy of the Board. Keeping in view of above it is recommended that CTO under the provision of Water Act/ Air Act/ Authorization under Hazardous and other Waste ( M& TM)WM, Rules 2016 may be granted ( 1.4.2017 to 31.3.2018) to the unit ( orange Category)with usual terms & Condition as per Policy of the Board and with the specific condition that unit will submit A/R under Water /Air Act( from all source of air emission)/Monitoring report under Noise Level rules within three months.

Observations still not addressed. Re-examine and re-submit point wise definite reasoned reply immediately.

As recommended by AEE,CTO under the provision of Water Act/ Air Act/ Authorization under Hazardous and other Waste ( M& TM)WM, Rules 2016 may be granted ( 1.4.2017 to 31.3.2018) to the unit ( orange Category)with usual terms & Condition as per Policy of the Board and with the specific condition that unit will submit A/R under Water /Air Act( from all source of air emission)/Monitoring report under Noise Level rules within three months.

As recommended by RO, may if approved, grant the consent to operate under Water Act , 1974, Air Act,1981 and authorization for disposal of Hazardous waste under HWM Rules, 2016 for the expansion project only for the period w.e.f. date of approval of this case upto 31.3.2018 with usual terms and conditions specified by the board and recommended by RO along with following additional conditions: 1. The unit will submit the analysis reports of trade effluent, air emissions/ noise, from all sources as applicable, with in 3 months and will keep all parameters with in standards prescribed under Environment (Protection) Rules,1986 by running and maintaining pollution control measures/ devices regularly and effectively. . 2.The unit will comply with the HWM Rules. 3. Unit will maintain the record of Haz. waste in form 3 and will submit the Annual Report under HWM Rules,2016 by 30th June every year. 4. The unit will submit the Environment Statement by 30th September every year. 5.Unit will deposite balance consent fee if any found due at any stage. 6. Unit will maintain the log book for ETP/STP and APCM REGULARLY and will submit the copy of same to the Board on Quarterly basis. 7.Unit will apply for renewal of consent/Authorization at least 90 days before expiry date of the consent/Authorization.

Recommended for grant of Consent to Operate the unit under the provisions of Water and Air Acts and authorization under HW & OM Rules for the period from the date of approval to 31.03.2018 with general and specific conditions applicable, as proposed.
