SCN be issued to the due to following deficiencies:- 1. Unit has not submitted annual return under HWM Rules for the year 2015-16 2. SCN for closure under section 33-A of Water (Prevention and Control of Water) Act, 1974 & 31-A of Air (Prevention and Control of Pollution) Act, 1981 was issued to the unit vide this office letter No. HSPCB/DHR/2016/4091 dated 02.01.2017, as per air emission& Effluent from final disposal of the unit, sample analysis Report No.200-201 dated 06.12.2016 & Report No.532 dated 08.12.2016 respectively from Board’s lab, parameters were exceeding the prescribed limits. But unit has neither replied nor done any compliance so far. 3. Unit has not submitted auto renewal performa for CTO as per policy of the board. 4. Cost mentioned in C.A. certificate and investment cost mentioned in online application is different.

As per board's policy order dated 24.02.2016, inspection of the unit was carried out after taking due permission from the competent authority. As per effluent A/R No 532 dated 08.12.2016 from Board's lab and air emission A/R No.200-201 dated 06.12.2016, parameters were exceeding the prescribed limits. SCN for closure was issued to the unit and unit replied for that. Recommendation for re-sampling for ETP and air emission was sent to H.O. vide this office letter No.4881 dated 17.03.2017. Matter may kindly be taken up with Head Office for re-sampling of ETP and air emission so that CTO case may be decided within stipulated time period please.

In this connection it is intimated that re-sampling request for ETP and air emission from stack to boiler/stack to thermopack of the unit was sent to head Office and competent authority considered the unit request for resampling of ETP and air emission from stack to boiler/stack to thermopack. This office received letter regarding resampling of ETP and air emission from stack to boiler/stack to thermopack of the unit from Head office vide letter No.3870 dated 01.05.2017 received on 02.05.2017 through email. Head office desired that “the permission for inspection and sampling of air emission and effluent from ETP of the above said unit is hereby accorded to you with the following conditions, in case the unit has already modified and upgraded their pollution control measures as reported by you/unit and submit your recommendations accordingly after inspecting the site:-1. The inspection/sampling will be carried out by the officer who has not conducted the previous inspection of the unit in recent past. 2. The provisions of the inspection policy will be complied strictly. 3. Unit will not install new boiler without obtaining prior CTE”. Hence keeping in the view of above, officer may kindly be deputed to carry out inspection and re-sampling of the unit as soon as possible as case is pending since 124 days, so that CTO case of the unit may be decided within stipulated time period please.

Sh. Mohit Moudgil, AEE have already been deputed in compliance of Head office letter reffered above as previous inspection was carried out by you as per information provided by You. Take up matter immediately and resubmit case.

Sir, it is intimated that in compliance to Head office direction issued vide letter No.3870 dated 01.05.2017 for inspection and re-sampling of the unit, your good-self has deputed Sh. Mohit Moudgil, AEE to carry out inspection and re-sampling of ETP and air emission from stack to boiler and stack to thermopack on 04.05.2017. But till the date orders of your good-self has not been complied. The CTO case of the unit is pending in OCMMS since 202 days in want of inspection. It is once again requested to kindly direct the AEE to carry out inspection so that the case of CTO of the unit may be processed within stipulated time period please.

Unit is engaged in manufacturing of life saving drugs. Unit has earlier obtained CTO from Board vide letter No. HSPCB/Consent/ : 2779015REWCTO1526301 Dated:04/03/2015. Unit has applied for CTO under Air Act 1981, Water Act 1974 and authorization under HWM Rules, 2016. Unit has submitted CTO fees of Rs. 457200/- vide online payment No. 64451402 dated 30.12.2016, CA certificate, affidavit, manufacturing process, previous year of copy of consent, agreement with authorized recycler for disposal of hazardous waste, performa for auto renewal of CTO, annual return under HWM. A Compliant was received from the villagers of village kapdiwas and permission for inspection was sought from competent authority. With due permission of competent authority, inspection was carried out and as per A/R No.200-201 dated 06.12.2016 of air emission and A/R No.532 dated 08.12.2017 of effluent from final outlet of unit, parameters were exceeding the prescribed norms. SCN was issued to the unit under relevant acts. Unit replied by submitting the scheme of modification of APCM and ETP. Request for resampling of air emission from stack and effluent from ETP of the unit was sent to Head office vide this office letter No.4881 dated 17.03.2017.Head office vide letter No.3708 dated 11.04.2017, asked for explanation for various observation. Reply of explanation was sent to head office vide this office letter No.170 dated 12.04.2017. Head office vide letter No. 3870 dated 01.05.2017 granted permission for re-sampling of the air emission and effluent from ETP of the unit with condition that inspection/sampling of the unit will be carried out by the officer who has not conducted the previous inspection of the unit. Inspection/resampling of the unit was assigned by regional officer to Sh. Mohit Moudgil, AEE and inspection of the unit was carried out by him on 29.07.2017. As per A/R No.220-221 dated 04.08.2017 effluent from outlet of ETP and A/R No.61-62 dated 02.08.2017 from the stack of air emission, parameters were found within the limits (copy attached). As per the report of Sh. Mohit Moudgil, AEE, ETP and APCM installed by the unit were operating satisfactorily during inspection. DG set are installed with acoustic enclosure. Therefore, keeping in view the above, it is recommended that Consent to Operate under Air Act, 1981, Water Act, 1974 and authorization under HWM Rules, 2016 may be granted to the unit for the period from 01.04.2017 to 30.09.2021 along with general & specific conditions of the board with following additional conditions: 1. Unit will keep all parameters with in prescribed limits by running and maintaining pollution control measures/ devices regularly and effectively. 2.The unit will comply with the HWM Rules. 3. Unit will maintain the record of Haz. waste in form 3 and will submit the Annual Report under HWM Rules,2016 by 30th June every year.4. The unit will submit the Environment Statement by 30th September every year. 4.Unit will deposite balance consent fee if any found due at any stage. 5.Unit will utilize their treated effluent as declared in their application. 6. Unit will maintain the log book for ETP and APCM REGULARLY and will submit the copy of same to the Board on Quarterly basis. 7. Unit will apply for renewal of consent/Authorization at least 90 days before expiry date of the consent/Authorization.

As recommended by AEE,Consent to Operate under Air Act, 1981, Water Act, 1974 and authorization under HWM Rules, 2016 may be granted to the unit for the period from 01.04.2017 to 30.09.2021 along with general & specific conditions of the board with following additional conditions: 1. Unit will maintain the record of Haz. waste in form 3 and will submit the Annual Report under HWM Rules,2016 by 30th June every year.4. The unit will submit the Environment Statement by 30th September every year. 4.Unit will deposite balance consent fee if any found due at any stage. 5.Unit will utilize their treated effluent as declared in their application. 6. Unit will maintain the log book for ETP and APCM REGULARLY and will submit the copy of same to the Board on Quarterly basis. 7. Unit will apply for renewal of consent/Authorization at least 90 days before expiry date of the consent/Authorization.

AAQ reports and noise monitoring reports for DG sets not attached.

Keeping in view of submission of AEE, CTO/Authorization under the relevant Acts/Rules may be granted as already recommended please.

Consent to Operate under Air Act, 1981, Water Act, 1974 and authorization under HWM Rules, 2016 may be granted to the unit for the period from 01.04.2017 to 30.09.2021 as recommended by RO.

The undersigned, under the powers conferred by the Government of Haryana, vide its order No. 2/13/2016-1 Env dated 19.06.2017, approves the proposal for grant of consent to operate the unit under the provisions of Water and Air Acts, with the terms and conditions applicable, as proposed. RO is directed to issue the consent for the same and (without closing the application) resubmit the proposal for authorization under HWM Rules again for approval by the competent authority.

Issue CTO as approved and then resubmit the proposal for authorization under HWM Rules again for approval by the competent authority as directed by MS.
